In our country, we have different gambling laws. The Central Law controls the first ones. Then, we have the State laws. Lastly, some laws depend on whether the game is physical or online, and if it’s a game of skill or chance.
Game of Skill Vs Game of Chance: The Difference
In Indian law, a game is called a skill game if skill mostly decides the outcome, while a game relying on luck is called a chance game.
The Supreme Court of India (SC) explained what “mere skill” means, saying games where success depends more on skill than luck aren’t gambling but are considered skill games.
In the case that saw State of Andhra Pradesh v K. Satyanarayana & Ors. and State of Bombay v R.M.D. Chamarbaugwala, the Supreme Court tested rummy to see if skill or chance is more important. It decided rummy is a skill game, unlike games like “Teen Patti Flush”, which are based on chance. Although shuffling and dealing cards involve chance, rummy needs skills, like remembering card sequences and choosing which cards to keep or discard to make a strong hand. These contests are like businesses, protected by Article 19(1)(g) of the Constitution of India, 1950, which covers the right to work in any profession.
Is a game of skill taxed the same as a game of chance?
Before, the GST rates for games varied based on whether they were skill-based or chance-based. But starting from October 1, 2023, there’s no difference in GST rates between games of skill and games of chance. Both types of games are taxed at a flat rate of 28%.
Is Poker a Game of Chance or Skill in India?
In India, the classification of poker as a game of chance or skill has been a subject of debate for quite some time. The legal perspective on this matter varies depending on the interpretation of relevant laws and court rulings.
Poker is generally considered a game of skill rather than a game of chance. This viewpoint is supported by the fact that successful poker players demonstrate consistent patterns of strategic decision-making, psychological insight, and mathematical calculations, all of which require skill and expertise.
However, the legal status of poker in India is complex and varies from state to state. Some states have laws that specifically exempt games of skill from gambling regulations, while others have more restrictive interpretations. In states where poker is classified as gambling, its legality may depend on whether real money is involved, the venue where the game is played, and other factors.
